The "Officious bystander" might have something to say about that but hopefully the "reasonable man" wouldn't put up with to much petty officious interferrence or red-tape and some sort of a equitable balance may be maintained.
Well, at least until European or Nepolionic law takes over and everyone is guilty, agwedo or whatever until proved innocent and then we are all sort of stuffed really.
Mind you this government has already been quite successful in introducing 'strict liability' and not a lot of mitigation there just put up and shut up or if don't automatically accept guilt pay double or triple the amount.
Can't wait until the DVLA and local authorities also has my bank or credit card number so that they can just help themselves to my account and save me the bother of paying my 'fixed penalty' fines.

You only have to look at all the cases of companies failing in their duties under health and safety law on this website, to understand the need to review 'reasonably practicable'.
It was a 'get out clause' back in 1974, it remains one now and will always be a get out cluase - voluntarism is not the way forward with health and safety in any society that unfortunatley is run by greed. In the current 'credit crunch' situation, further cost-cutting and corner-cutting will increase rather than decrease, leading to more and more incidents as reported by Workplace Law.
This is a missed opportunity and one that once again panders to business.
