Was this an employment issue or a criminal offence? it appears this is relevant only to criminal offences, since he was no longer at work when the offences took place.

Employment or Criminal ! !! Are you suggesting that because some offences may have been reported out of work after having been subjected to a prolonged period of bullying at work that this should mitigate the bullies behaviour in the first place ?
Perhaps then we should all get away with 'banter' and/or 'teasing' just so long as it's after work and why not give that annoying work collegue a good smack after work as well for good measure.
Just because you have somehow put a little distance between the workplace and further on-going unremitting antisocial beahviour doesn't mean you are no longer the bully or that there is a difference between verbal abuse at work and physical abuse out of work for the victim - Just what are you saying ?
The abuse verbal and physical was sustained to the point of 'harrassement' regardless of the form that it took and included 'assault' and no doubt 'battery' along the way it just beggars belief that it was allowed to go on for so long.
Whilst not wanting to be too nasty I hope the bullies learn something from their experience of being at the bottom of the pecking order in the big house.
