I need to know the legal position regarding Ministers in the Methodist Church.
Are they "employees"? Are they "employed"?
What is the case law on this subject, please?
What is the test?

Take a look at New Testament Church of God v Rev. Sylvester Stewart.

Hi James. Thanks for that I am aware of the cases
Diocese of Southwark v Coker 1998 ICR 140CA
Percy v Church of Scotland House of Lords UKHL 2005 73 15/12/2005
New Testament Chuch of God v Stewart EAT 2006 17/10/2006 and the sequel
Court of Appeal[2007] EWCA Civ 1004
I am also aware of the Statement in The House on the 20th March 2007 by the Minister for Employment Relations in which he said that the Clergy Working Group had developed a model statement of good practice. So far as I am concerned this has merely served to muddy the waters and has no legal standing.
I was hoping that someone might be able to give me some further knowledge - has the subject been considered in the EU Court for instance?
Regards
Colin
