Hi,
Please could someone advise me. We are a very small company and have just taken on a trainee. He has been with us for just 14 working days and has now hurt his arm as a result of one of his friends pushing him off his moped. This did not happen while he was at work. He has been told by a doctor to rest the arm until he feels better but was given no specific time or any written sick note. The problem is that the trainee has a manual job with us and we feel that he may not be able to perform his normal day to day duties and we cannot afford to ' carry ' him for doing practically nothing all day. We have told him to have a week off to give the arm a good rest and that we will not make him do any heavy lifting for a reasonable period when he returns but if he cannot perform even light manual duties what are we to do? We don't want to be sued for discrimination but why should we continue to pay someone if he cannot do the job expected of him. How do we stand during a probation period ( 3 months )? If he returns to work and then even light duties cause his injury to hurt again can we then give him notice or will we get sued. Do we have to go through the verbal/written warning procedure? I'm extremely worried as my husband and I have worked so hard to get this business together and I would hate the thought of someone suing us for discrimination when he didn't even have the accident at work.
