The title of this article is misleading, since the government has not even published its draft new TUPE regulations. The government has already made it clear that it would be impracticable to apply TUPE, as such, to pensions ie transferee's will not be required to replicate transferor's pension schemes in full, however generous. Instead, it will offer some degree of protection to transferring employees
