Whatever has happened to personal resposibility?
The hours one works ought to be no one's responsibility but one's self. How did mankind ever develop? By initiative, not dictat. Similarly, one should ensure one's own safety;
unless the employer actually forces a person to do an illegal act, he should not be liable.

Whilst not knowing the details of the incident there are a few fundementals that counter Mr Cowburns comments. Health and Safety legislation worldwide is based on the premise that those in control of, and profit from, an enterprise are responsible for providing a safe place of work for those they employ. Construction sites if not controlled have the potential to be complex dangerous places with not all of those dangers obvious. Personal responsibility is necessary but not absolute as it requires full knowledge of the dangers, which simply isn't viable for every employee in every circumstance, and doesn't factor in financial pressures and the fact that if the legislation wasn't there anyone complaining gets shown the door.
Are we really prepared to tolerate consequences the survival of the fittest. Even the 18th Century liberal philosophies that Mr Crowburn infers were mitigated with the requirement that people who required protection be provided with it.
