Lack of transparency and accountability in discretionary bonus awards increases the risk of discrimination claims. The burden of proof (i.e. to prove that any less favourable treatment was not caused by an employee's sex) will be on the employer. Employers are therefore advised to adopt objective systems of assessment, to justify all awards.
