Is anyone aware of any case law showing who might be held liable for faults on a wheelchair owned by a patient/service user but being pushed by a member of staff? We obviously have a comprehensive inspection and maintenance programme in place (we are a LA) but some local managers are now worried that their staff might be liable if a person's own wheelchair or one supplied by NHS or a charity collapsed while the person was in our care.
Guidance or case law would be very useful in helping to come to a decision. I know what I think but a bit of back up is always useful?
