Very interesting. I do believe that the next development of employment law will be to look at people who work for a supplier but who spend the majority of their time working on behalf of one single end-user company, and decide that a look-through test should reveal an implied contract direct with that end user.
This could be especially relevant in cases where the supplier staff work alongside (or as appearing as part of) the end user. Examples could be where IT or facilities or cleaning has been outsourced and staff of the supplier sit alongside staff of the end-user and they allege some kind of disparity.
Hopefully I'm wrong, but...
