I have two members of staff that are currently working their notice period of 4 weeks:
1. one has taken more holiday that he would be entitled to, can I reclaim this from his final salary if I advise him in writing in a letter.
2. The other has holiday entitlement remaining can I force him to take this to finish earlier rather than paying him for it?

1 - possibly, it depends whether your T&Cs reserve the right to do this.
2 - yes probably. If for example he had three days' leave left, you could write to him giving the requisite notice (under statute it is double the notice for the period of leave) six days in this case. Does your contract of employment say anything about this?
