My Company does not pay sick pay unless the employee is off as a result of an industrial injury, and then only flat rate.
In addition, if one of our employees is off due to attending hospital for an operation, in some cases for several weeks, they too do not get paid.
What is the legal stance on this please as I find it very unfair.

I was under the impression every-one who pays National Insurance was entitled to statutory sick pay.
As I understand it, the payment is made by the employer on behalf of the Government. The employer is entitled to claim a contribution towards the payment which is deducted from the payment of national insurance contributions. In order to be eligible an employee must be employed, under the age of 65 and have earnings of at least the lower earning limit.
Am I wrong? Perhaps there are other exceptions?

Yes, sorry, we pay statutory sick pay but no form of company sick pay.
I take it then that there are no laws governing the requirements of providing company sick pay?

There is no legal requirement for you to pay company sick pay, only SSP.
