This case is a classsic example of why health and safety is seen as a problem in relation to moving and handling older and disabled people. I very much hope that the learning from this case will be the right learning, i.e. that it was the employer's failure to properly train the staff member in moving and handiling techniques, not the fact that she had to move the person at all. i hope that this case does not result in social services departments taking a step back and telling private care home staff not to move residents at all, in the past this has resulted in older and disabled people being left in bed for days on end, getting bed sores and other problems. The key factor is proper trainng and monitoring of day to day practices to ensure the balance between staff welfare and the rights and welfare of older and disabled people is maintained.
