As wel as accident books, we record summary information of all accidents for all buildings on a company intranet. Only two people have an overview of all records. We do not have fields asking for personal details but some staff name an individual in the description i.e. "Mrs Miggins fell in reception.... " Could this be considered a breach of Data Protection?

Generally speaking, there is nothing wrong with identifying individuals in accident reports, particularly if it assists in your compliance with your requirements under health and safety legislation. If it is necessary to identify individuals in order to comply with health and safety legislation , the information should be held securely and only seen by those who have responsibility for such matters. Your question however suggests that you are recording accident details to collect statistical information and that that information is stored on a company intranet to which presumably some or all employees would have access. If this is the case, the records on the intranet should be anonymised, as should any information retained for statistical purposes.

Hi Diane
There is an issue over Accident Books at work. Currently, when you make an entry into most existing accident books, you are able to view previous entries made in the book - allowing access to personal details and information. The Information Commissioner has ruled that this is an infringement of the Data Protection Act.
In order to overcome this issue the Health and Safety Executive (HSE) has launched its new Accident Book. Nothing odd about that. But this one has been approved by the Information Commissioner... The new design, produced by the HSE, allows for accidents to be recorded, with personal details stored separately in a secure location.
How paranoid must we get...
