Increased employment risks for users of temporary workers?

The Court of Appeal, in deciding the appeal raised by Brook Street against a cleaner, Mrs Dacas, suggested that temporary workers will in many cases be deemed to have employment rights against end users. While the judgment related to a PAYE temp in a cleaning role, it may also apply to higher paid workers and those who supply their services via personal services companies (including umbrella companies). The key issue was the element of day to day practical control.
