Revised guidance for employers who sponsor migrant workers

    The UK Border Agency has published revised guidance for employers who sponsor migrant workers under the points-based system.

     

    The sponsor guidance has been revised for employers who sponsor migrant workers under tiers 2 and 5 of the points-based system. The guidance documents, together with a list of changes from the previous guidance, can be downloaded from the UK Border Agency website 

     

    Tier 2 is for those skilled workers who have received a job offer from a UK employer and Tier 5 is for temporary workers.  

     

    The revisions for employers include:

     

    • Revised guidance on choosing an immigration adviser (Tier 2).
    • Updated guidance on which jobs don’t have to be advertised in job centres (Tier 2).
    • Usually, a certificate of sponsorship must be assigned within six months of the date the vacancy is first advertised. The guidance has a revised list of exceptions to this six-month rule (Tier 2).
    • Revised guidance on the suspension of licences (Tier 2/5).

    Workplace Law is working with immigration specialists, DavidsonMorris Solicitors, to offer expert advice on managing the new immigration regulations that came into force in November 2008.
